Terms of Sale

These Terms of Sale apply to every order placed in the North Mile online store. We sell to consumers (private individuals buying for purposes outside their trade or profession) and to business customers. Where a section applies to only one group, it says so. Nothing in these terms reduces the rights that consumers have under the mandatory consumer protection law of the country where they live.

1. Seller

The seller is North Mile. Questions about an order can be sent to info@north-mile.com.

2. How a contract is made

  • Product listings on the Site are an invitation to order, not a binding offer.
  • By clicking Place Order you make an offer to buy the products in your cart.
  • We send you an e-mail confirming that we have received your order. The contract is concluded when we confirm the order or dispatch the products, whichever happens first.
  • We may decline an order, for example if a product is no longer available or a price was obviously wrong. If we have already charged you, we refund the full amount.

3. Prices and payment

  • Prices are shown in the currency of the region you select. Applicable taxes and shipping costs are shown before you place the order.
  • Business customers in another EU country with a valid VAT number may be invoiced under the reverse-charge mechanism where the law allows it.
  • Payment is processed by our payment provider. We do not store full card details.
  • Payment is due when the order is placed.

4. Delivery

  • We deliver to the countries offered at checkout, to the address you give us.
  • Delivery times shown on the Site are estimates. If we cannot deliver within 30 days of the contract, consumers may cancel the order and receive a full refund.
  • For consumers, risk of loss passes when the products are delivered to you. For business customers, risk passes when the products are handed to the carrier.
  • Please check the parcel on arrival and tell us within 7 days about any visible transport damage or missing items.

5. Right of withdrawal (consumers only)

If you are a consumer, you can withdraw from the contract within 14 days without giving a reason. The procedure, exceptions and refund rules are set out in our Returns Policy. Business customers do not have a statutory right of withdrawal; voluntary returns for business customers are also described there.

6. Warranty and defects

  • Consumers have the statutory rights for products that are not in conformity with the contract, for the period set by the law of the country where they live: in the EU at least two years from delivery, and three years for consumers in Spain (see section 10). We will repair or replace a defective product, or, if that is not possible, reduce the price or refund you.
  • For business customers, the warranty period is 12 months from delivery, and defects must be reported in writing without undue delay after they are discovered.
  • Cutting tools wear with use. Normal wear, breakage caused by incorrect cutting data, unsuitable machines or materials, improper handling, or modifications such as regrinding are not defects.

7. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of essential contractual obligations, limited to the damage typically foreseeable when the contract was made. Towards business customers, liability for indirect damage, loss of production and lost profit is excluded to the extent the law allows.

8. Retention of title

Products remain our property until they have been paid for in full.

9. Applicable law and disputes

  • These terms are governed by the law of the country in which North Mile is established. For consumers, this choice of law does not remove the protection of the mandatory provisions of the law of the country where they live.
  • For business customers, the courts at North Mile's place of business have jurisdiction.
  • The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  • If you have a complaint, please contact us first at info@north-mile.com; we aim to resolve it amicably. Unless section 10 provides otherwise for consumers in your country, we are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board. Your right to go to court is not affected.

10. Country-specific provisions for consumers

The following additional provisions apply to consumers who live in the countries named. Where the general sections above say otherwise, these provisions take precedence.

Spain: For goods bought on or after 1 January 2022, consumers who live in Spain have a legal guarantee of conformity of three years from delivery under the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, as amended by Royal Decree-Law 7/2021).

France: Under Article L612-1 of the French Consumer Code (Code de la consommation), consumers who live in France have the right to refer a dispute with us to a consumer mediator (médiateur de la consommation) free of charge, after first trying to resolve it directly with us by a written complaint sent to info@north-mile.com. Consumer mediator: [Name and website of the consumer mediator — to be completed].

Turkey: Under Consumer Protection Law No. 6502, consumers who live in Turkey may apply to the consumer arbitration committee (Tüketici Hakem Heyeti) for disputes up to the monetary limits set each year by the Ministry of Trade, and to the consumer courts (Tüketici Mahkemesi) for disputes above these limits.
